2017 Road to Rome Raffle

Capuchin Province of Mid-America, Inc., a Colorado non-profit corporation, also known as CPMA, a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting this raffle.  The following rules and regulations covering and regulating the Capuchin Province of Mid-America, Inc.’s Road to Rome Raffle are enacted pursuant to Section 12-9-101 et seq. of the Colorado Revised Statutes and Article XVIII, Section 2 of the Colorado Constitution.  By purchasing a raffle ticket the purchaser agrees to be bound by these rules and regulations.

  1. There shall be a total of four (4) prizes awarded in conjunction with the Road to Rome Raffle:  the Grand Prize, Refer-A-Friend Prize, Multi-Ticket Prize and the October Early Bird Prize.

(a) The Grand Prize shall be four (4) roundtrip airlines tickets to Rome, Italy and will include a one-week stay at the Hotel Alimandi Vaticano, [Viale Vaticano 99 – 00165 Rome, Italy] in a Quadruple Room that sleeps four (4). Grand Prize includes a day trip for four (4) to Assisi, Rome.  In the event that the property is no longer owned or managed by respective contact, the property will be replaced with a property of equal or lesser value in Rome, Italy.  Property may not be exchanged for other comparable properties. Air travel must originate from, and return to, a major continental United States international airport or other international airport (provided the fare from such international airport does not exceed the average fare from Chicago, Denver, and Los Angeles international airports on the same date of travel).   Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Grand Prize are not included and are the sole obligation of the winning party.  The trip will be scheduled for a designated week during 2018, based on availability and the Grand Prize winner’s preference.   Travel must take place between January 1, 2018– December 31, 2018.  The Grand Prize winner is required to submit preferred travel dates [based on published availability] to the CPMA within forty (40) days of winning the raffle and must include 1st and 2nd preferred weeks.  In the event that the submitted dates are not available, the winner will be asked to submit a new list of preferred travel dates. The Grand Prize drawing will take place on Wednesday, December 20 at approximately 7pm Mountain Time at the Governor’s Residence at the Boettcher Mansion 400 East 8th Avenue Denver, Colorado 80203.

All raffle tickets purchased (except the Refer-A-Friend and the Multi-Ticket raffle tickets which will be issued separately) will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.

(b) The Refer-A-Friend Prize shall be two (2) round trip airline tickets to Seattle, Washington and a 7-Night Alaskan Inside Passage Cruise aboard the Royal Caribbean Celebrity Solstice, in an Ocean View Stateroom.

Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Refer-A-Friend Prize are not included and are the sole obligation of the winning party.  The prize must be used between January 1, 2018 – December 31, 2018.  Air travel must originate from, and return to, a major continental United States international airport or other international airport (provided the fare from such international airport does not exceed the average fare from Chicago, Denver, and Los Angeles international airports on the same date of travel).  Winner may choose from the following Royal Caribbean Celebrity Solstice cruise departure dates: May 25, June 15, Aug 10 or Aug 24, 2018. The Celebrity Solstice departs from Seattle, Washington. The Refer-A-Friend Prize winner is required to submit their first and second choice cruise departure dates to CPMA within forty (40) days of winning the raffle, travel dates are subject to availability and cannot be guaranteed.  In the event that the submitted dates are not available, the winner will be asked to submit their third and fourth choice selection.   The Refer-A-Friend Prize Drawing will take place on Wednesday, December 20, 2017 at approximately 6:45pm Mountain Time at the Governor’s Residence at the Boettcher Mansion 400 East 8th Avenue Denver, Colorado 80203

All Refer-A-Friend Prize raffle tickets will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.  The winner of the Refer-A-Friend Prize will also be eligible to win the Multi-Ticket Prize (if three or more tickets were purchased) and the Grand Prize.

(c) The Multi-Ticket Prize shall be two (2) round trip airline tickets to Paris, France and a 7-night stay at the Holiday Inn Paris Opera, Grands Blvd (30-32 Boulevard Poissonnière, 75009 Paris, France). Package includes: roundtrip airport transfers to and from the hotel; admission to the summit of the Eiffle Tower with a host; admission to the Louvre Museum and a tour of the Notre Dame Cathedral. Package is based on double occupancy including taxes and fees. Tourist tax at hotel is not included and must be paid directly to the hotel, ranging from 1-5 Euros per person/per day. Pricing is based on travel during shoulder season, April 1-May 15 or October 1-31, 2018. Any variation to this package will be at the expense of the winner.  The prize must by used between January 1, 2018 – October 31, 2018.   The Multi-Ticket Prize winner must submit their first and second choice travel dates that fall within the above-listed shoulder season dates within forty (40) days of winning the raffle, travel dates are subject to availability and cannot be guaranteed.  In the event that the dates selected are not available, the winner will be asked to select a second set of dates from the above-listed shoulder season dates. Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Multi-Ticket Prize are not included and are the sole obligation of the winning party.  Air travel must originate from, and return to, a major continental United States international airport or other international airport (provided the fare from such international airport does not exceed the average fare from Chicago, Denver, and Los Angeles international airports on the same date of travel).  The Multi-Ticket Prize drawing will take place on Wednesday, December 20 at approximately 6:50pm Mountain Time at the Governor’s Residence at the Boettcher Mansion 400 East 8th Avenue Denver, Colorado 80203. The winner of the Multi-Ticket Prize will also be eligible to win the Refer-A-Friend Prize and the Grand Prize.

All raffle tickets purchased within the timeframes set forth in Section 12 below (other than the separately issued raffle tickets for the Refer-A-Friend and Multi-Ticket drawings) will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.

(d) The October Early Bird Prize shall be Airfare for two [2] to South Carolina and a 4-night stay at the Sonesta Resort, Hilton Head Island (130 Shipyard Drive, Hilton Head Island, SC 29928) in an ocean view room. Any related federal, state and local income or excise taxes, applicable gratuities, tips, security or damage deposits, and additional elective costs associated with the Early Bird Prize are not included and are the sole obligation of the winning party.  The prize must by used between January 1, 2018– December 31, 2018 subject to availability.  The Early Bird Prize winner will be asked to provide their first and second choice travel dates within forty (40) days of winning the raffle, travel dates are subject to availability and cannot be guaranteed.  In the event that the submitted dates are not available, the winner will be asked to submit a second set of travel dates. The October Early Bird Prize Drawing will take place on Friday, October 20, 2017 at approximately 9:45 p.m. Mountain Time at the Denver Sheraton Hotel, 1550 Court Place, Denver, CO 80202. All raffle tickets purchased (except for the Refer-A-Friend and Multi-Ticket raffle tickets which will be issued separately) will be placed in a drum and the winning ticket will be randomly selected from the drum by a CPMA representative or other CPMA designated person.  The winner of the Early Bird Prize will also be eligible to win the Grand Prize,  Multi-Ticket Prize (if three or more tickets were purchased) and the Refer-A-Friend Prize (if terms were met to be entered).

  1. Refer-A-Friend Ticket Drawing:  Eligible raffle ticket participants who buy at least one (1) raffle ticket and Refer-A-Friend who buys at least one (1) raffle ticket will receive a bonus entry into the Refer-A-Friend Bonus Drawing provided that the following criteria is met: referrer is acknowledged by the referee on the raffle ticket order form. In order to receive credit the name of referee provided by referrer must match the spelling on the referee’s purchased ticket to receive credit or the misspelled name must have the same phone or email as provided by the referrer. Refer-A-Friend Ticket qualifiers will be issued a separate raffle ticket for the Refer-A-Friend Drawing for the chance to win the Refer-A-Friend Prize. The referee will receive a Refer-A-Friend Bonus Ticket for each unique referral received [ie: if two people you refer each purchase a raffle ticket, referee will receive two entries into Refer-A-Friend drawing; if three referred friends purchase a raffle ticket, referee will receive three entries, etc].  Referee cannot refer himself or herself.
  2. Multi-Ticket Drawing: In order to be entered in the Multi-Ticket drawing, three or more tickets must be purchased. When purchaser buys three or more tickets an equivalent number of tickets will be entered into the Multi-Ticket Drawing.  Credit will only be applied to the buyer of the ticket who purchased three or more tickets. In specific cases, a purchaser will buy tickets but gift them to someone else; however, credit will only be given the purchaser.
  3. Each prize is subject to, and each prize winner is fully responsible for, any and all federal, state, and local income or excise taxes, fees, and like charges associated with the prize (“Taxes”).  CPMA and all contracted associated parties have no responsibility for the payment of any Taxes or fees associated with the prize.  At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners before distribution of a prize.  The current withholding rate is twenty-five percent (25%), and each prize winner shall be obligated to submit to CPMA, for withholding purposes, a cash payment that equals the equivalent of twenty-five percent (25%) of the fair market value of the prize at least ten (10) business days before the prize is distributed to the prize winner. The prize will be deemed distributed, and no longer forfeitable, to the prize winner on the date that is the first day in which CPMA or the prize winner incurs any non-refundable fees on behalf of the winner for arrangements in furtherance of commencing prize travel Please consult your tax advisor for any questions.  If a raffle ticket purchaser is unable to pay the Taxes associated with the prize at the time the prize is distributed, then that person will be automatically disqualified and a second prize winner will not be drawn].
  4. The winner or a representative appointed by the winner, will be the exclusive point of contact for coordinating travel arrangements.  Any additional travel arrangements that fall beyond the scope of the prize are the exclusive financial and organizational responsibility of the winner.
  5. The fair market value for each of the prizes is estimated as follows: the Grand Prize package is estimated at $2,000 – $3,200 plus applicable airfare depending on the season of travel; the Refer-A-Friend Prize is estimated at $2,896-$3,196 plus applicable airfare depending on the season of travel; the Multi-Ticket Prize is estimated to be $2,600 plus applicable airfare; and the October Early Bird Prize is estimated at $1,850 plus applicable airfare depending on the season of travel.
  6. The price per chance is as follows: $50 for one (1) raffle ticket, $135 for three (3) raffle tickets purchased together, $220 for five (5) raffle tickets purchased together, and $400 for ten (10) raffle tickets purchased together, subject to a $100 maximum discount per transaction.  Group sales of (100) raffle tickets are $3,750 and can be purchased by phone at 303.477.5436 or in person at the CPMA Administration Offices.  Only one person may be listed as the owner of each ticket. When utilizing the Multi-Ticket purchase discount, only one person may be listed as the owner of the Multi-Ticket series.  For purposes of the Refer-A-Friend Tickets the original purchasers of the tickets will be the qualifying party for the Alaskan Cruise drawing, provided that they meet the stated requirements.  All purchases of raffle tickets are non-refundable for any reason except a raffle cancellation.  In the unlikely event the raffle is cancelled (in accordance with Colorado Secretary of State Rule 9.A.S.), all credit cards will be credited with the full amount that was paid to the raffle within forty-five (45) days and all parties paying by check or cash will be sent a refund within forty-five (45) days.  All of the credit card and electronic check raffle ticket purchases online will be processed by http://clickandpledge.com/ Corporation.  Raffle tickets are payable by any of the following means:

(a) On-line Credit Card Payments:  On-line credit card payment may be made at www.RoadtoRomeRaffle.com.  Credit card payments are processed immediately and raffle ticket(s) is/are issued following credit card approval.

(b) Mail-In Form: Official Entry Form can be downloaded from www.RoadtoRomeRaffle.com.  Completed forms and payments with check or credit card information may be mailed to: 3613 Wyandot St., Denver, CO 80211.  Checks should be made payable to: CPMA (Capuchin Province of Mid-America, Inc.).  A purchaser who purchases raffle ticket(s) with a check may pick up the purchased raffle tickets at the CPMA Administration Building at 3613 Wyandot St., Denver, CO 80211 during normal office hours, Monday-Friday, 9 a.m. – 4 p.m. Mountain Time after 10 days of CPMA’s receipt of check.  Alternatively, the purchased raffle tickets eligible for the Early Bird Prize may be picked up on October 20, 2017 after 6:00 p.m. Mountain Time at the Denver Sheraton, 1500 Court Place, Denver, CO 80202, if the purchased raffle tickets are not eligible for the Early Bird Prize, on Tuesday, October 24, 2017 after 9:00 a.m. Mountain Time at the Capuchin Province of Mid-America Administration Offices, 3613 Wyandot street, Denver. Colorado 80211.

(c) By Phone: Official Entry Forms are available by calling 303.477.5436 and can be mailed or credit card information can be taken over the phone.

(d) In Person:  Raffle tickets may be purchase in person at the CPMA Administration Building at 3613 Wyandot St., Denver, CO  80211 during normal offices hours, Monday-Friday, 9 a.m. – 4 p.m. Mountain Time.

  1. Checks and credit cards purchases will be deposited upon receipt.  Checks returned for insufficient funds or other reasons, or credit cards that are denied shall disqualify the raffle ticket(s).
  2. Per Internal Revenue Service regulations, the raffle ticket purchase price is not deductible for income tax purposes as a charitable deduction.
  3. All prize winners will be notified by phone and/or e-mail and by certified mail within seven (7) days of each drawing.   Winner must accept the prize in writing via email or U.S. postal service within 30 days of the notification. If the prize winner does not formally accept the prize in writing within 30 days of notification, a second attempt will be made by the CPMA to contact the winner via U.S. postal service certified mail; return receipt requested. If the prize has not been accepted in writing within thirty (30) days of the winner’s receipt of this second notification, a second prize winner will not be drawn.
  4. By entering this raffle, entrants accept and agree 1) to be bound by all the rules, limitations, and restrictions set forth herein (the “rules and regulations”), and 2) that their names and/or likeness may be disclosed to and used by the news media, may otherwise be used by CPMA for publicity purposes, may be published in any newspaper, and may be announced on the Brown Robe Benefit Website (www.brownrobe.org).  CPMA’s interpretation and application of the rules and regulations shall be final.
  5. Raffle Ticket Entry Deadlines:

(a) All electronic entries must be received and processed by Friday, October 20, 2017, 7:30 p.m. Mountain Time and all entries by check must be received by Friday, October 6, 2017 (to accommodate for Columbus Day) to be eligible for and entered into the October Early Bird Drawing.

(b) Refer-A-Friend Deadline:  All electronic entries must be received and processed by Monday, December 18, 2017 at 11:59pm Mountain Time and all entries by check must be received by Wednesday, December 6, 2017 to be eligible for and entered into the Refer-A-Friend Drawing.

(c) Multi-Ticket Deadline: All electronic entries must be received and processed by Monday, December 18, 2017 at 11:59pm Mountain Time and all entries by check must be received by Wednesday, December 6, 2017to be eligible for and entered into the Multi-Ticket Drawing.

(d) Grand Prize Deadline:  All electronic entries must be received and processed by Monday, December 18, 2017 at 11:59pm Mountain Time and all entries by check must be received by Wednesday, December 6, 2017to be eligible for and entered into the Grand Prize Drawing.

  1. Winners need not be present to win.
  2. Requirement: Participants must be 18 years of age or older to enter the raffle and to be eligible for prizes.  Winners may be required to provide proof of eligibility including driver’s license, social security number, and applicable contact or verification information. Winners may also be asked complete a Publicity Release Form.
  3. The odds of winning the Grand Prize will be one (1) divided by the total number of raffle tickets actually sold.  If the number of raffle tickets sold is less than 1,500 by the time of the raffle drawing, the Grand Prize may exclude airfare.  A maximum of 3,300 raffle tickets will be sold.
  4. CPMA NEITHER MAKES NOR PROVIDES REPRESENTATION, GUARANTEE, OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE GRAND PRIZE, REFER-A-FRIEND, MULTI-TICKET, OR EARLY BIRD PRIZE THAT ARE AWARDED IN CONJUNCTION WITH THE RAFFLE.  PURCHASER TICKET HOLDER ACKNOWLEDGES AND AGREES THAT CPMA IS NOT RESPONSIBLE NOR LIABLE FOR THE CONSTRUCTION OR CONDITION OF THE VACATION PROPERTIES AND/OR COMPLICATIONS, DELAYS, LAYOVERS, OR OTHER ISSUES THAT ARISE WITH RESPECTIVE AIRLINE CARRIER(S).
  5. Prizes are not transferable.  The Road to Rome Raffle is subject to all applicable federal, state, and local laws and regulations and is void wherever prohibited or restricted by law.
  6. Forfeit procedure.  A second winner will only be drawn if the first winner is ineligible.
  7. Net proceeds of the Road to Rome Raffle are solely for the benefit of the Capuchin Province of Mid-America, Inc., a 501(c) 3 non-profit organization registered in Kansas and authorized to transact business in the State of Colorado.
  8. Each raffle ticket purchaser hereby releases CPMA and its directors, employees, residents, affiliates, donors, and the owners of the prizes awarded in this raffle from any injuries, losses, or damages of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award, acceptance, or use of any prize, or that person’s failure to comply with applicable law; and (b) releases and agrees to indemnify, defend, protect, and hold harmless CPMA and its directors, employees, residents, affiliates, and donors from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award, acceptance, or use of any prize, or that person’s failure to comply with applicable law.  Each raffle ticket purchaser hereby represents and warrants to CPMA that he/she has read and understands these rules and regulations and agrees to be bound by these rules and regulations and CPMA decisions, which are final.  In the case of any dispute, CPMA’s decision shall be final. Any liability of The CPMA shall be limited to the raffle ticket price paid.
  9. Subject to the approval of the Colorado Secretary of State, the CPMA may elect to add raffle prizes and/or extend the raffle-drawing deadline for the Grand Prize, the Refer-A-Friend Prize and the Multi-Ticket Prize to an alternative date prior to December 31, 2017. In the event this occurs, the modified information shall be sent to each raffle ticket purchaser by U.S. mail or email at the address listed on the entry form.
  10. Employees, members, and the children and spouses of an employee of CPMA are not eligible to purchase raffle tickets in the Road to Rome Raffle.  In the event that an employee, member, or a child or spouse of an employee of CPMA raffle ticket is drawn for a prize, that person will be automatically disqualified and an alternate winner will be drawn.
